The health certificate. How to apply, and what applying late costs.

Everyone explains what an export health certificate is. Almost nobody explains how to apply for one, with how much notice, and with which payment receipt attached.

In brief

You apply to the ASL for your area, on its own form, by certified email. Each health authority sets the notice it needs: ASL TO5 states three working days, ASL Novara five for food of non-animal origin.

It's charged by the hour. Legislative Decree 32/2021 sets an hourly rate for export-related activities. ASL TO5 publishes what it charges: €80 an hour, with €60 for the first certificate with an inspection and €20 for each further one the same day.

Applying late is a cost item. Article 8 of the same decree adds a 30 per cent surcharge when the check is requested with less than 24 hours' notice, as well as at night or on public holidays.

The files are free. There's no form in the way, we don't ask for an email address, and we don't get notified when anyone downloads them. Step zero on the sheet is the three things to look up on your ASL's website: the form, the right department's address, and the notice period it states.

Who to apply to

To the ASL (local health authority) responsible for the area where your production site is. Within the ASL, the department depends on the product: the food hygiene and nutrition service for food of non-animal origin and food contact materials, the veterinary service for food of animal origin, feed and by-products.

ASL TO5, for example, publishes three different addresses depending on the branch. It looks like an irrelevant detail, and it isn't: a request sent to the wrong department isn't rejected, it's forwarded, and meanwhile the notice period you'd planned for has been used up.

So the first thing to do isn't to write. It's to open your ASL's page and find the form, the address and the notice period that ASL states. The differences between health authorities are real, and you can't guess them.

The notice period, which varies from ASL to ASL

There's no national notice period. Each health authority publishes its own, and the range you find by reading three different pages is wide enough to ruin a shipment for anyone who went by the wrong ASL.

The practical lesson of this table isn't “you need three days”. It's that you read the number off your own ASL's page, once, and then write it down somewhere the person preparing shipments will find it without looking.

What to attach

Each ASL publishes its own form, and they differ, but the supporting documents are similar. The same items keep coming up: ID for the legal representative or owner, full details of the consignment to be certified, and the receipt for payment of the fee.

A less obvious attachment, explicitly requested by ASL 3 Liguria, is the packing list with all the required details. It makes sense: the certificate has to describe the same goods as the other documents, and this is where consistent paperwork becomes a requirement rather than good practice.

It's also why it pays to put the shipment's paperwork together before you apply for the certificate, not after. The same goods have to be described the same way on the invoice, packing list and certificate, as explained in documents for a food shipment abroad.

What it costs: charged by the hour

Legislative Decree no. 32 of 2 February 2021 establishes that export-related work is paid for by the operator and charged by the hour. Article 10(2) explains how it's calculated: the hourly rate multiplied by the hours or fractions of an hour worked by each officer, and it makes a point almost nobody mentions.

The smallest fraction of an hour counted is one minute, and travel time isn't included when working out the fee.

The decree puts the hourly amount in an annex published as an image, which we weren't able to read. But individual health authorities publish it: ASL TO5 states that the rate is €80 an hour (Annex 3, section 1), and builds a readable fee schedule on that basis.

It's a recurring cost, and it grows with every market you open.

These are the amounts published by one health authority, not a national tariff: the hourly rate comes from the decree, and each ASL publishes how it applies it. The value of this table lies in the order of magnitude and the structure, not in the exact figure for your province.

The 30 per cent surcharge

This is the point that changes how you work, and it's in Article 8(1) of the decree. The hourly rate goes up by 30 per cent when a check requested by the operator takes place between 18:00 and 06:00, on public holidays, or on working days when the request comes in less than 24 hours before the scheduled time.

The third case is the one that affects everyone. Urgent issue isn't a paid extra you buy when you need it. It's the same service, with a surcharge that kicks in because you asked late. ASL 3 Liguria says so directly, stating a 30% surcharge on the standard fee for issue within 24 hours.

There's also a fixed surcharge that's less well known: Article 8(4) adds 0.5 per cent to almost all fees, to fund the multi-year national control plan. It won't change a quote, but it explains why the amount you're charged is never exactly the one in the fee schedule.

Finally, the cost of export-related lab checks, including analyses, tests and diagnostics, is paid by the operator on top of the fee. If your product or the destination country requires sampling, that's a separate item to ask about beforehand, not to discover on the invoice.

The certificate template, and when it has to be negotiated

Not every certificate already exists. Where Italy and the destination country have a bilateral agreement, or the template is agreed at EU level, there's a form to fill in. Where there isn't, you start from a generic template whose descriptive section can be adapted to the case.

That “can be adapted” means someone has to agree the wording, and agreeing wording between three parties in two countries adds days that don't appear in any notice period. That's why the question to ask the buyer on day one isn't whether a certificate is needed, but which template their customs will accept.

The date that can't be moved

There's one constraint that makes any later fix pointless, and it's why this whole procedure has to be done ahead of time rather than chased. A certificate can't be issued if the goods' departure date is earlier than the certification date.

In other words, you can't get the document afterwards. If the goods have left, there's no bureaucratic way to fix it after the event, and what you're left with is a consignment held at destination and a buyer who isn't to blame. It's the most expensive mistake in the whole subject, and it always has the same cause: nobody asked in time.

When the notice period stops living in someone's head

With two shipments a year, the person who applied the first time remembers the notice period. With twelve shipments to five countries, each with its own template and its own ASL, what gets lost is almost never a rule. It's always, and only, a date.

That's when the deadline needs to come out of people's memory and into a place that watches it by itself, with operational deadline alerts that count back from the shipping date. On a declaration to the health authority, that sign-off is substance, not formality.

Read the number once on your own ASL's page, then write it down where the person preparing shipments will find it without looking. Going by another health authority's notice period is a very real way to lose a shipment.

Can you get the certificate after the goods have left?

No. A certificate can't be issued if the goods' departure date is earlier than the certification date, and there's no bureaucratic way to fix it after the event.

The result of a late request is a consignment held at destination, with a buyer who isn't to blame. It's the most expensive mistake in the subject, and it always has the same cause: nobody asked in time.
